1. Provider and scope

These terms of use apply to the use of GAP Optimizer by registered users. The provider is Ludwig Wagner, GAP Optimizer, Brahestraße 38, 10589 Berlin, Germany. Contact details can be found in the legal notice.

2. Scope of services

GAP Optimizer supports the structured recording of farm information, the review of funding eligibility requirements, the comparison of plans, and the creation of traceable review reports for the eco-schemes. The features available at any given time are described within the application. The application for funding itself is submitted via the competent German state portal.

3. Significance of the results

The results are based on the data entered and the rule versions shown within the application. They do not constitute a funding decision and are not a guarantee of approval or payment. Only the competent authorities decide with binding effect. Any open requirements and supporting evidence must be clarified before the application is submitted.

4. Registration and user account

A personal user account is required for the full scope of features. The information provided during registration must be accurate and up to date. Access credentials must not be passed on to unauthorized third parties. Users must notify us without delay if they suspect unauthorized use of their account.

5. Responsibility for input and supporting evidence

Users are responsible for ensuring that the farm data, land, crops, measures and supporting-evidence information they enter are complete and accurate. Before submitting an application, the calculation, the underlying information and all required supporting evidence must be professionally reviewed. Notices given by the application must not be removed or treated as already fulfilled while the underlying requirement is in fact still open.

6. Permitted use

The application may only be used within the framework of applicable law and for one's own farms or in the course of a legitimate advisory activity. In particular, the following are not permitted: circumventing access restrictions, automated attacks, manipulating review results, and using third-party data without authorization.

7. Availability and updates

We strive to operate the service reliably. Brief interruptions may occur in particular due to maintenance, security measures or technical faults. Rule versions and features may be adjusted where legal provisions, administrative requirements or technical requirements change. Results already stored may as a result be marked as no longer current.

8. Own content and white-label features

Users may only upload content and logos they are authorized to use. They grant us the usage rights technically required for storing, displaying and creating the review reports they request. These rights end once the content has been deleted and no legal or technically necessary retention grounds stand in the way.

9. Data protection and client data

Information on the processing of personal data is provided in the privacy policy. Anyone entering data relating to other individuals or farms must be authorized to do so and must inform the affected individuals where required. To the extent GAP Optimizer processes personal data on behalf of an adviser, a data-processing agreement must be concluded before any corresponding use.

10. Free use and term

The use currently offered for claim year 2027 is free of charge. There is no automatic conversion into a paid subscription. Paid offers, should they be introduced, would be communicated separately and transparently before any contract is concluded. The user account runs for an indefinite period and can be terminated at any time via the account-deletion feature provided.

11. No guarantee for calculation results

GAP Optimizer is supporting calculation and documentation software. Despite careful development and regular updates, errors, incomplete rule representations, or deviations from administrative practice cannot be entirely ruled out.

We provide no guarantee that calculation results, funding status, payment amounts or notices are correct, complete or up to date in every individual case. The results do not constitute a funding commitment or a funding decision and create no claim against any authority.

Users are obliged to independently review, or have a qualified person review, their input, calculation results, supporting evidence and deadlines before submitting an application. The user remains responsible for the application and the information used in it.

Liability is otherwise governed by statutory provisions. In the case of a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable, typical damage. Otherwise, liability for slight negligence is excluded.

12. Protection against competitive evaluation

(1) A direct competitor is any natural or legal person who, either itself or through an affiliated company, develops, offers or markets software or a digital service for reviewing, calculating, planning or optimizing CAP funding, eco-schemes, or directly comparable agricultural funding measures.

(2) Direct competitors are prohibited from using non-publicly-accessible areas of the platform for the purposes of competitive analysis, commercial benchmarking, or the development, improvement or marketing of a competing product, without the provider's prior consent in text form. Non-publicly-accessible areas are all areas of the platform whose use requires registration or login.

(3) In particular, the following are prohibited for these purposes:

  • a) the systematic or automated querying of a large number of test cases or calculation results;
  • b) evaluating or reproducing non-publicly-accessible workflows, result structures, user-interface flows, documentation or data models;
  • c) automated extraction, scraping, load or performance testing, and circumventing technical access restrictions;
  • d) accessing the platform under a false identity, via third-party accounts, or on behalf of a direct competitor;
  • e) using non-public insights obtained to replicate or specifically further develop a competing product.

(4) This does not cover the ordinary, intended use of the platform to review or plan one's own agricultural farm, or for specific advice to individual clients, provided the insights gained are not used for the development, improvement or marketing of a competing product.

(5) Mandatory statutory rights, in particular acts permitted by law for examining computer programs, remain unaffected.

(6) Where there are concrete indications of a breach, the provider may temporarily suspend the affected access and, having set a reasonable deadline, request a statement. In the event of a substantial or continued breach, the provider may terminate the contract for good cause. Further statutory claims remain unaffected.

13. Governing law

German law applies. Mandatory consumer-protection provisions and statutory places of jurisdiction remain unaffected. Should any individual provision of these terms of use be invalid, the remaining provisions remain valid.
